Welcome to SparkBooks, a software-as-a-service (SaaS) platform that helps engineers generate one-line diagrams, panelboard schedules, and load reports.
These Terms of Service ("Terms") govern your access to and use of the SparkBooks platform, including all related services and features (collectively, the "Service"). By using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Service.
1. Eligibility & Account Registration
To use SparkBooks, you must register for an account using a valid email address, password, and payment information. By creating an account, you represent that all registration information you provide is accurate and that you will keep it up to date.
You agree to keep your login credentials confidential and not share your account with others. Unauthorized use of your account is strictly prohibited.
2. Subscription and Payments
SparkBooks is a paid service, processed via Stripe. New users may begin with a free 7-day trial. After the trial, a paid subscription is required to continue using the Service.
Subscriptions renew automatically on a monthly basis unless canceled. You may cancel your subscription at any time, and your access will continue until the end of your current billing period. No refunds are provided for unused time.
3. User Content and Ownership
You retain all rights to the designs, calculations, and output you create using SparkBooks. We claim no ownership over your project data.
By using the Service, you grant SparkBooks the limited right to store and process your data as needed to provide the Service.
4. Use at Your Own Risk
SparkBooks offers automated tools to support the design process but does not guarantee the accuracy, completeness, or compliance of its outputs with engineering standards, building codes, or legal regulations.
You agree that you are solely responsible for verifying the results produced by the software, and for any professional decisions based on them.
SparkBooks and its owner disclaim all liability for errors, omissions, or damages arising from the use or misuse of the Service.
5. Acceptable Use
You agree not to use the Service to:
- Reverse-engineer, probe, or disrupt the platform
- Circumvent authentication or security measures
- Share or sell access to your account
- Upload malicious content or attempt to harm other users or the platform
Violation of these terms may result in account suspension or termination.
6. Account Suspension and Termination
SparkBooks reserves the right to suspend or terminate accounts for any reason, including violation of these Terms or misuse of the Service.
Canceled or terminated accounts will retain their user and project data unless requested otherwise. If you return later, your data can be restored.
7. Modifications to the Service
We may modify or discontinue features or services at any time without prior notice. We’ll make reasonable efforts to notify users of significant changes.
8. Governing Law
These Terms are governed by and interpreted in accordance with the laws of the State of Colorado, USA, without regard to conflict of laws principles.
